System for Taking down Online Sexual Harassment Content is Established in Thailand泰國建立「下架網路性騷擾內容」機制

On 26 January 2026, the Court of Justice of Thailand introduced the “Take It Down” procedure through the Court Integral Online Service (“CIOS”) platform,[1] allowing the public to report explicit content and request its removal 24 hours a day, in response to recently revised sex crime laws. It is a fast-track judicial process system enabling victims and people affected by cyber sexual abuse can file complaints directly with the Criminal Court.
泰國法院於2026年1月26日透過「法院整合線上服務」(簡稱「CIOS」)平台推出「下架」程序,以因應近期修訂的性犯罪法律。此程序允許大眾每天 24 小時舉報顯露內容並請求刪除。這是一套司法快捷處理系統,使受害者及受網路性虐待影響的人可以直接向刑事法院提出申訴。
The establishment of the system is based on Section 284/4 of the Penal Code, which is introduced by the Act Amending the Penal Code (No. 30) B.E. 2568 effective from 30 December 2025. According to Section 284/4, an injured person or a competent official may petition the court to suspend dissemination of violating data and remove the data from computer systems within a court-specified period. The court may also direct system controllers, service providers, or competent authorities to carry out the order and report back within 15 days.
此系統是基於《刑法》第 284/4 條建立,該條款是由2025年12月30日生效的《佛曆2568年刑法修正案(第30號)》所引入。根據第 284/4 條規定,受害人或主管官員可向法院提出請求,要求在法院指定的期限內,停止傳播違法數據並從電腦系統移除該數據。法院亦得指示系統管理員、服務供應商或主管機關執行該命令,並在15日內回報執行結果。
The Judiciary Online Services System or The CIOS platform serves as the main electronic channel for petitions. The following are key features of the CIOS:
司法線上服務系統或CIOS 平台是提交申請的主要電子管道。以下是 CIOS 的核心功能:
Ø Individuals report explicit images or videos and request their deletion at any time when the platform is available.
個人可在平台開放的任何時間,舉報顯露影像或影片,並請求予以刪除。
Ø Users must complete digital identity verification via the ThaID application to access the CIOS. There are also plans to expand the system to support identity verification through the NDID platform or other accredited applications, in order to further facilitate public access to the judiciary’s online services.
使用者必須透過 ThaID 應用程式完成數位身分驗證,方可進入 CIOS 系統。此外,還有計劃擴展該系統,以支援透過 NDID 平台或其他認可的應用程式進行身份驗證,從而進一步方便公眾訪問司法部門的線上服務。
Ø Users do need have to go through police or physically visit a court.
使用者不需要經過警察部門,也無須親自前往法院。
Ø Petitions under Section 284/4 are limited to requests to suspend or remove violating content. Claims for monetary damages must be pursued separately, including via separate proceedings or prefiling mediation.
根據第 284/4 條提出的申請,僅限於要求暫停傳播或移除違法內容。若要請求金錢賠償,必須另行提起訴訟,包括透過獨立訴訟程序或起訴前調解。
After completing the submission, the petition will be reviewed before passing it to a judge for consideration. The court may conduct an online inquiry to obtain additional information, and physically attendance is required only if when court considered it as necessary. Once an order is issued, it will be sent electronically to service providers or relevant authorities for execution, enabling swift takedown of unlawful content.
完成提交後,申請書將先經過審核,隨後轉交由法官裁決。法院可能會進行線上詢問以獲取補充資訊,只有在法院認為必要時,才需要親自出庭。一旦發布命令,將以電子方式發送給服務供應商或相關機關執行,以便快速下架違法內容。
Under the previous process, victims had to report explicit online content to police under the Computer Crime Act. The case would then go through several procedural steps before reaching the Criminal Court, which often caused delays. With the introduction of CIOS, victims can now submit their complaints directly to the court, significantly shortening the process.
在先前的流程下,受害者必須根據《電腦犯罪法》向警方報案檢舉網路上的露骨內容。案件隨後需經過多道程序步驟才能送達刑事法院,這往往導致處理上的延誤。隨著 CIOS 的推出,受害者現在可以直接向法院提交申訴,顯著縮短處理流程。
Currently, the petitions filed through the CIOS are handled by the Criminal Court. While the platform accepts reports 24 hours a day, court officials will review and approve complaints only during official working hours. Paper filings remain available and may be filed at any competent first-instance court during court working hours, consistent with ordinary jurisdictional rules.
目前,透過 CIOS 提交的申請由刑事法院負責處理。雖然該平台全天 24 小時接受舉報,但法院人員僅會在正式辦公時間內進行審查與核准投訴。此外,紙本申報方式依然有效,民眾可根據一般管轄權規則,於法院辦公時間內向任何具管轄權的初審法院提出申請。
According to Office of the Judiciary Letter No. SorYor 016/Wor 87 issued on 23 January 2026, petitions under Section 284/4 of the Penal Code may be submitted no matter a criminal complaint has been filed for the underlying sexual harassment offense. If a criminal case is already pending, the petition may be filed with the trial court handling that criminal case. On the other hand, if no case has been filed, petitions may be made with courts having jurisdiction, including provincial courts and specified criminal courts, but excluding summary, juvenile and family, corruption, and specialized courts with limited subject-matter jurisdiction.
根據法院事務處於2026年1月23日發布的 SorYor 016/Wor 87 號函示,無論是否已針對該性騷擾犯罪行為提起刑事訴訟,皆可依據《刑法》第 284/4 條提交申請。若刑事案件已在審理中,可向負責該案的審判法院提出申請;另一方面,若尚未提起訴訟,則可向具有管轄權的法院提出申請,包括各省法院及指定的刑事法院,但不包括簡易法院、青少年與家庭法院、貪污與瀆職法院,以及其他受限於特定事項管轄權的專業法院。
